Eligibility
“Makeup.com’s The Stepfather Safety in Numbers” Sweepstakes (the “Sweepstakes”) is open only to current legal residents of forty eight (48) of the United States (excluding Rhode Island & Maine) or D.C. who are thirteen (13) years of age or older at time of entry. Employees of Sponsor (see below), Columbia TriStar Marketing Group, Inc., Foxy Originals Inc., Sleepyheads.com, The Popcorn Factory, Inc., and their respective affiliates (collectively, the “Sweepstakes Entities”) as well as members of such employees’ immediate families (spouses, children, siblings, parents), and/or persons living in the same household as such persons, whether or not related, are not eligible to participate in the Sweepstakes.

Makeup Incorporated, a wholly owned subsidiary of Makeup.com Limited (“Sponsor”), located at 3416 Via Lido, Suite F, Newport Beach, CA 92663, is the sponsor of this Sweepstakes
Sweepstakes Period; Entry
Entries for the Sweepstakes will be accepted beginning September 17, 2009 at 12:01 a.m. PT and ending October 21, 2009 at midnight PT (“Sweepstakes Period”). To enter, go to www.makeup.com (the “Sweepstakes Site”) and provide your first name, last name, street address (no P.O. Boxes), city, state, zip code, daytime telephone number (including area code), date of birth, e-mail address, and gender. There is a limit of one entry per person/per email address/ per day.
Limitation of Liability
Sweepstakes Entities are not responsible for lost, incomplete, illegible, late, misdirected, stolen, or mutilated entries, account information, mail or email or postage-due mail; failures or malfunctions of phones, phone lines or telephone systems; lost entries or transmissions; any error, omission, interruption, defect or delay in transmission, transaction processing, or communication; interrupted or unavailable network, server or other connections; miscommunications, failed computer hardware or software or technical failures; garbled, misrouted or scrambled transmissions; printing errors appearing within these Official Rules, in any Sweepstakes-related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, telephone, electronic, mail or otherwise. Sponsor reserves the right, in its sole discretion, to void any and all entries of an Entrant who Sponsor believes has attempted to tamper with or impair the administration, security, fairness or proper play of this Sweepstakes. The use of automated entry or similar devices is prohibited and entries through such devices are void. The authorized account holder of the email address submitted at the time of entry is defined as the natural person who is assigned to the email address by an Internet access provider, online service provider or other organization (i.e., business, educational institution, etc.) which is responsible for assigning email addresses for the domain associated with the submitted email address. Proof (to Sponsor's satisfaction) of being the authorized account holder may be required by Sponsor.
Selection of Potential Winner; Notification
On or about November 4, 2009, Sponsor will conduct a random drawing to select the potential Grand Prize winner of the Sweepstakes. Odds of winning depend on the number of eligible entries received during the Sweepstakes Period.
If the potential Grand Prize winner can’t be reached at the email address or telephone number provided on the entry form within five (5) business days from Sponsor’s first attempt to contact her/him, or if she/he is found to be ineligible, or if she/he can’t or doesn’t otherwise comply with these Official Rules, an alternate potential Grand Prize winner may be selected by Sponsor.
Prizes
One (1) Grand Prize will be awarded in this Sweepstakes. The Grand Prize consists of: One (1) $500 Shopping Spree at Makeup.com; one (1) $200 Foxy Originals gift certificate, to be redeemed online through a coupon code; six (6) pairs of Sleepyheads brand pajamas (approximate retail value (“ARV”) $300); six (6) Extreme Survival Kit Snack Assortments from The Popcorn Factory (ARV $59.99 each; $359.94 total); six (6) horror DVDs to be selected by Sponsor and/or its DVD prize provider (ARV of all six DVDs $120.00); and one (1) Sony High Definition Handycam® Camcorder (ARV $1099.99). The total ARV of the Grand Prize is $2,579.93.
ANY PRIZE IS AWARDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, EXCEPT ANY STANDARD MANUFACTURER’S WARRANTY.
Prize Restrictions
Makeup.com shopping spree must be redeemed within one (1) year from prize notification date and is not transferable or redeemable for cash. No extension will be given after expiration. No cash or other substitution, assignment or transfer of prizes permitted, except by Sponsor, who reserves the right to substitute a prize or prize component with another of equal or greater value. If the prize is not claimed within the specified time limit, the prize will be forfeited. Foxy Originals gift certificate is only redeemable at www.foxyoriginals.com on regular and sale priced merchandise. Gift certificate value will be subtracted from the total cost of the purchase, after taxes. Gift certificate cannot be refunded for cash or credit. Gift certificate is valid until May 1, 2010. Sleepyheads pajamas selected must be Sleepyheads brand.
All prizes are non-transferable and must be accepted as awarded. Sponsor retains the right to substitute prizes of equal or greater value based on availability.
Agreement to Terms
The Sweepstakes is subject to these Official Rules and all applicable federal, state, and local laws and regulations. By participating in this Sweepstakes, Entrant acknowledges that Entrant has read these Official Rules and agrees to abide by its terms and by the decisions of the Sponsor, which are final and binding on all matters pertaining to the Sweepstakes.
Sponsor will have the power to rule on all aspects of the Sweepstakes. The decisions of the Sponsor shall be final and binding. Sponsor reserves the right to cancel or modify the Sweepstakes in whole, or in part, in event of technical or other difficulties that make it impossible for the Sweepstakes to proceed as intended.
NONE OF THE SWEEPSTAKES ENTITIES NOR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES OR AGENTS (“RELEASEES”) SHALL BE RESPONSIBLE FOR, AND ENTRANTS BY ENTERING THE SWEEPSTAKES HEREBY RELEASE, DISCHARGE, INDEMNIFY AND HOLD HARMLESS RELEASEES FROM AND AGAINST ANY CLAIMS, COSTS, LIABILITY OR DAMAGES WHATSOEVER DUE TO ANY INJURIES, DAMAGES LOSSES TO ANY PERSON (INCLUDING DEATH) OR PROPERTY OF ANY KIND RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY FROM PARTICIPATING IN THE SWEEPSTAKES, SUBMITTING AN ENTRY, WINNING ANY PRIZE, ACCEPTANCE, POSSESION, MISUSE OR USE OF ANY PRIZE (OR PORTION THEREOF), OR PARTICIPATION IN ANY SWEEPSTAKES- RELATED ACTIVITY OR ANY DAMAGES WHATSOEVER OTHERWISE ARISING OUT OF THIS SWEEPSTAKES.

BY ENTERING THIS SWEEPSTAKES, THE ENTRANT AGREES THAT ANY AND ALL CLAIMS ARISING OUT OF THIS SWEEPSTAKES SHALL BE SETTLED BY FINAL AND BINDING ARBITRATION BEFORE THE AMERICAN ARBITRATION ASSOCIATION PURSUANT TO THE U.S. ARBITRATION ACT, 9 U.S.C. §1-16, OR BEFORE THE AMERICAN ARBITRATION ASSOCIATION UNDER ITS INTERNATIONAL ARBITRATION RULES IF THE CLAIM ARISES FROM CONDUCT OUTSIDE OF THE U.S. ANY SUCH CLAIM MUST BE FILED WITH THE AMERICAN ARBITRATION ASSOCIATION BY JANUARY 31, 2011, OR NO CLAIM OR ACTION MAY BE SUSTAINED
